Welcome to Candy AI. These Terms of Service ("Terms", "Agreement") govern your access to and use of the Candy AI website, platform, application, and any related services (collectively, the "Service"). By accessing, browsing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Candy AI platform.

1. Acceptance of Terms and Eligibility

Age Restriction: The Candy AI platform contains mature themes and interactions. You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction (whichever is greater), to access or use the Service. By creating an account or using the platform to interact with an AI girlfriend or AI boyfriend, you explicitly represent and warrant that you meet this age requirement. Candy AI reserves the right to request proof of age at any time and may suspend or terminate accounts suspected of belonging to minors.

Jurisdiction: You are responsible for ensuring that your use of the Service complies with all local, state, national, and international laws applicable in your jurisdiction. If the use of artificial intelligence companionship platforms is prohibited in your location, you are not authorized to use this Service.

2. Description of the Candy AI Service

Candy AI is an advanced artificial intelligence platform that allows users to create, customize, and interact with digital companions. The Service utilizes sophisticated Natural Language Processing (NLP), generative AI image models, and voice synthesis to create simulated conversations and interactions. You understand and explicitly acknowledge that:

  • The AI characters on Candy AI are fictional, computer-generated entities. They are not real people.
  • Any emotional connection, relationship, or scenario played out within the platform is entirely simulated for entertainment purposes.
  • The AI companions do not possess consciousness, real feelings, or self-awareness.
  • The Service is not intended to replace human interaction, professional counseling, medical advice, or psychiatric treatment.

3. User Accounts and Registration

To fully utilize the features of Candy AI, including the ability to create your AI character and generate images, you must register for an account. When creating an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.

You agree to immediately notify Candy AI of any unauthorized use of your account or any other breach of security. Candy AI will not be liable for any loss or damage arising from your failure to protect your login information. We reserve the right to suspend or terminate your account at any time, with or without notice, if we suspect any violation of these Terms.

4. Acceptable Use and User Conduct

Candy AI champions freedom of expression and provides a judgment-free zone for adults to explore digital companionship and roleplay. However, this freedom is not absolute. While using the Service, you agree not to engage in any of the following prohibited activities:

  • Illegal Content: Using the Service to generate, promote, or distribute any content that violates applicable laws.
  • Child Exploitation: Attempting to create, generate, or simulate any characters, images, or roleplay scenarios involving minors or individuals appearing to be under the age of 18. Candy AI employs strict zero-tolerance filters for such content, and any attempt to bypass these filters will result in immediate termination and potential reporting to law enforcement authorities.
  • Non-Consensual Imagery: Uploading real photos of non-consenting individuals (such as ex-partners, celebrities, or private citizens) to use as reference material for AI generation.
  • Hate Speech and Harassment: Using the platform to generate text or images that promote violence, terrorism, self-harm, or hatred against individuals or groups based on race, religion, sexual orientation, or gender identity.
  • System Abuse: Attempting to hack, disrupt, or overburden the Candy AI servers, reverse-engineer our machine learning models, or use automated scripts (bots, scrapers) to interact with the platform.

5. Intellectual Property Rights

Candy AI's Ownership: The Service, including but not limited to its underlying software, machine learning models, algorithms, interface design, logos, and pre-made AI characters, is the exclusive property of Candy AI and its licensors. These assets are protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of the text prompts and inputs you provide to the Service. When you generate an image or a text response using your Candy AI companion, Candy AI grants you a personal, non-exclusive, non-transferable license to use that generated content for your personal, non-commercial entertainment purposes. You may not sell, redistribute, or use the generated assets for commercial gain without explicit written permission from Candy AI.

6. Subscriptions, Billing, and Purchases

While Candy AI offers a free tier for new users, many of our premium features—including unlimited messaging, fast image generation, and premium voice synthesis—require a paid subscription. By electing to upgrade your account via our secure checkout portal, you agree to the following:

  • Recurring Billing: Subscriptions are billed on a recurring basis (monthly, quarterly, or annually) depending on the plan you select. Your payment method will be charged automatically at the beginning of each billing cycle.
  • Cancellations: You may cancel your subscription at any time through your account settings. Cancellation will prevent future charges, but you will retain access to your premium features until the end of your current paid billing period.
  • No Refunds: All purchases are final. We do not offer prorated refunds for partially used subscription periods, except where required by applicable law.
  • Token Systems: Certain features may utilize a virtual token system. Tokens have no real-world monetary value, cannot be exchanged for cash, and expire upon the termination of your account.

7. Privacy and Data Security

Your privacy is of the utmost importance to us. We understand the deeply personal nature of the interactions you have with your Candy AI companions. Our data collection, storage, and sharing practices are detailed in our separate Privacy Policy. By agreeing to these Terms, you also acknowledge and consent to our Privacy Policy. We employ industry-standard encryption protocols to protect your chat logs, account data, and payment information.

8. Disclaimer of Warranties

THE CANDY AI SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Candy AI makes no warranty that (i) the Service will meet your specific requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results or generated content will be accurate, reliable, or appropriate for your specific situation, or (iv) the quality of any products, services, or information purchased or obtained by you through the Service will meet your expectations. The AI may occasionally produce hallucinatory, inaccurate, or nonsensical responses.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CANDY AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless Candy AI, its parent company, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Service caused damage to a third party.

11. Modifications to the Terms and Service

Candy AI reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. We also reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Candy AI's primary corporate entity is registered, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration, using the English language, in accordance with the comprehensive arbitration rules and procedures of a recognized arbitration body selected by Candy AI.
